This document establishes the Terms and Conditions that govern the contract of tourist and adventure services offered by At Peru Expedition S.A.C. (hereinafter, “the Company”), with RUC 15615314398. By making a reservation, making a payment, or using our website, the customer (hereinafter, “the Passenger” or “the Client”) expressly and fully accepts the conditions detailed herein.
1. Booking and Confirmation Process
- 1.1. Booking Request: All booking requests must be made digitally (via our website, email, or official messaging channels).
- 1.2. Guarantee Deposit: To confirm and secure a booking for any tour or trek, the Client must make an initial non-refundable deposit equivalent to 30% or 50% of the total cost of the service (depending on the chosen route and the need to purchase nominative train tickets or entrance fees to Machu Picchu).
- 1.3. Confirmation: The booking will only be considered officially confirmed once the Company verifies the receipt of the deposit and sends a “Service Confirmation Voucher” via email.
2. Payment Methods and Deadlines
- 2.1. Balance Payment: The remaining balance (the total cost of the trip) must be paid before the start of the experience according to the following deadlines:
- For day trips (Full Days) and extreme adventure activities: the balance can be paid up to the morning of the tour itself.
- For multi-day treks (such as Salkantay or Ausangate): the balance must be paid 100% at least 48 hours prior to the service start date (during the briefing).
- 2.2. Payment Methods: We accept local bank transfers, digital payment gateways (Visa, Mastercard, Amex, PayPal credit/debit cards), and cash payments (US dollars or Peruvian soles). In accordance with Peruvian banking policies, cash bills must not have tears, markings, or stamps.
3. Cancellation and Refund Policies
Due to the nature of tourist services in Cusco (where entrance tickets to Machu Picchu, the Inca Trail, and train tickets are strictly nominative, non-transferable, and non-refundable), the following penalties apply in the event of cancellation by the Client:
- Cancellations made more than 30 days in advance: The amount paid will be refunded, minus administrative fees incurred and the cost of non-refundable tickets already purchased (Machu Picchu, trains, etc.).
- Cancellations made between 15 and 29 days before the service: A penalty of 50% of the total value of the tour will apply.
- Cancellations made less than 14 days in advance or “No Show”: A penalty of 100% of the total value will apply. No refunds of any kind will be issued.
4. Modifications and Rescheduling
- 4.1. Requested by the Client: Any request to change dates or itineraries is subject to the availability of trains, hotels, and Machu Picchu entrance tickets, and may incur additional administrative fees charged by third-party providers.
- 4.2. Due to Force Majeure: The Company is not responsible for delays, modifications, or cancellations caused by force majeure events such as natural disasters, strikes, road blockages, extreme weather conditions, or unforeseen government regulations. In these cases, we will work to offer the best possible alternative or rescheduling, but refunds for amounts already paid to third parties are not guaranteed.
5. Health Requirements and Travel Insurance
- 5.1. Health Declaration: The Client is obligated to disclose any pre-existing medical conditions, allergies, dietary restrictions, pregnancy, or physical disabilities at the time of booking. By participating in high-mountain treks or extreme activities, the Client declares that they are in a state of health compatible with such physical activities.
- 5.2. Altitude Sickness (Soroche): It is the Passenger’s responsibility to undergo a proper acclimation process (we recommend a minimum of 2 days in the city of Cusco or the Sacred Valley before starting demanding treks).
- 5.3. Travel Insurance: It is a mandatory requirement for every traveler to have active international travel insurance covering medical assistance, mountain rescue, accidents, loss of luggage, and repatriation.
6. Conduct, Safety, and Liability
- 6.1. Guide Instructions: Throughout the tour, Passengers must strictly follow the directions of the lead guide. The Company reserves the right to remove any Client from the tour, without any right to a refund, if their behavior compromises their own safety, or that of the group, staff, or visited ecosystems.
- 6.2. Substance Use: The consumption of illegal drugs or excessive alcohol is strictly prohibited immediately prior to or during high-mountain treks or extreme adventure sports.
7. Intellectual Property and Use of Image
By participating in our expeditions, the Client authorizes At Peru Expedition to make non-commercial use of photographs or videos taken during the routes, to be published exclusively on our digital channels (website, Instagram, TikTok, Facebook). If the Client prefers not to appear in this content, they must expressly state so to the guide or operations staff before the start of the activity.
8. Governing Law and Jurisdiction
Any controversy, dispute, or claim arising from the interpretation or execution of these Terms and Conditions shall be resolved under the laws of the Republic of Peru. Both parties expressly submit to the jurisdiction of the courts of the city of Cusco, Peru, waiving any other jurisdiction.
